Terms and Conditions

Commercial Furniture Makers Australia Pty Ltd (CFMA) trades in the state of Victoria, and in the Commonwealth of Australia. It is bound by the laws relating to the Trade Practices Act and the guidelines and laws of Victoria.

Quotations

Any quotation issued by Commercial Furniture Makers Australia Pty Ltd shall be null and void after the expiration of thirty (30) days from the date of issue.

Specifications

CFMA reserve the right to change prices, dimensions, design and construction without prior notice.

While a pricelist is issued annually, please note that these prices are standard, and costs vary according to:

(a)              Alterations to height, width, depth, leg style and foam grade.

(b)              Pattern matching of fabrics: this may require additional fabric metreage.

(c)               Selection of complex and/or difficult to manufacture products: specifically, we encourage the avoidance of selecting Crypton fabrics with hardened, cardboard type backing, as these are near impossible to upholster. The additional time required to overcome such difficulties, is realised through additional costing.

Commercial Furniture Makers Australia Pty Ltd will not be liable for any claim arising from failure to deliver, or for delay in delivery occasioned by unavailability of materials, strikes, accidents or any cause or event beyond the reasonable control of the company.

Orders

The Sales Order is a documented contract under common law and as such is binding on both parties to the contract. Therefore any variations or alterations to the order must be agreed by both parties and must be confirmed in writing.

Orders placed on the weekend or on a Public holiday will not begin processing until the next business day.

Business days are Monday through Friday, excluding VIC Public holidays.

CFMA reserves the right to refuse the upholstery of furniture in fabric that, in our professional opinion is deemed unsuitable for the chosen furniture.

Due dates for orders may not precede 4 weeks from delivery of fabric. Whilst we will endeavour to complete your order as soon as possible, allowance must be made for the existing work schedule.

Express production may incur an additional cost. 

To ensure the accuracy of your order internally, CFMA codes are required on all orders. Orders will not be processed until such requirements are met.

CFMA representatives are available to answer any questions concerning our furniture; however, the client is solely responsible for the final selection, including the suitability of a particular covering, colour and model. We encourage careful selection as refund and exchanges do not apply.

Tax

Unless otherwise stated, all prices quoted exclude GST.

Order Cancellations and Modifications

Additional charges may be applied to cancelled or modified orders. These charges cover loss of value, administration and inventory costs, and other associated expenses.

Orders may not be cancelled once delivered.

If an order is cancelled by CFMA, any payments made to us will be refunded within 30 days of the cancellation.

Delivery

CFMA deliveries
Delivery dates are approximate only. The estimated shipment date on your order is based on product availability and order processing time.

The company will use its best endeavours to meet any delivery date but such date is an estimated delivery date only and shall not be a condition of this agreement. The company shall not be liable for any loss or damage of any kind or description whatsoever suffered by the purchaser by reason of any delay in the delivery of the goods caused by any matter or thing over which the company has no control.

Upon delivery the customer will be asked to sign a delivery docket. Once this document has been signed by the customer, it is deemed that the goods have been reviewed for

            (a)       The non-arrival of any or all of the goods;

            (b)       Damage or fault;

            (c)       The correct goods;

            (d)       Correct quantity;

            (e)       Compliance to specifications.

Once the representative has left the customers’ premise, all liability of damaged or faulty goods will be passed to the customer, and the warranty period begins.

Sales firms are totally responsible for ensuring that ordered goods can be properly received into the required delivery location and that they will fit through all openings for the goods to be delivered.  If, in the professional opinion of the delivery employee, the delivery cannot be undertaken without potential damage to the goods or property because of restricted openings or limited access, the employees will not complete the delivery.  Under these circumstances the Salesman can (at their own expense):

            (a)        Elect to have the goods delivered to another location, or

            (b)        Complete a rejected delivery form and have the goods returned to CFMA for new arrangements to be made.

Where CFMA confirms a delivery day, and the customer fails to be available or cannot accept the goods because of inadequate access, or fails to pay according to the agreed terms of payment, an additional charge will apply for a second delivery of the order, as will the initial delivery fee apply.  The minimum charge for a second delivery is $80.

If the purchaser does not accept delivery of the goods at the time or times and in the manner agreed, the purchaser shall be liable to the company for all loss and expense incurred by the company caused by such non-acceptance including the cost of storing the goods.

Delivery fees are based on the number of items, destination, and ease of delivery.

Orders requiring more than one (1) delivery, will incur a delivery fee per delivery.

The company does not deliver Products to any address outside Australia.

Placement on delivery

The standard delivery service allows for delivery to a ground floor, or higher level location where goods may be safely transported in suitable lifts. Please note that deliveries will not be made, where entrance to the location requires trespassing through another person’s property, or over balconies.

Deliveries that require unloading to an area more than 30 metres from unloading area, may incur an additional charge.

Please note that the following services are not included in a standard delivery charge:

(a)       Removal of packing materials of wrapped furniture.  (This includes timber, cardboard, bubble wrap, fibre bags and plastic.)

(b)      Exact in home location, including levelling, adjusting or cleaning of any furniture.

(c)       Movement of any other furniture.
